Prayer: Criminal Revision Petition filed under Sections 397 & 401 of Criminal Procedure Code, praying to set aside the conviction imposed in the judgment dated 02.06.2015 made in C.A.No.17 of 2011 on the file of the learned Additional District Sessions Court, Namakkal confirming the judgment dated 26.05.2011 made in S.T,C.No.1035 of 2007 on the file of the learned Judicial Magistrate-I, Namakkal by allowing this Criminal Revision Petition.

(The case has been heard through video conference) When the matter is taken up today, Mr.R.Prabakar, the learned counsel appearing for the petitioner would submit that https://hcservices.ecourts.gov.in/hcservices/

notice sent to the petitioner through RPAD had been returned with an endorsement ''Addressee died''. He would further submit that he is unable to get instructions with regard ti the legal heirs of the petitioner.

2. This Court, directed the learned Government Advocate (Crl.Side) to find out about the status of petitioner. Mr.T.Shanmugarajeswaran, the learned Government Advocate (Crl.Side) would submit that on the directions of this Court he had contacted Mr.Ganesan, Inspector of Police, Mohanur Police Station, and he had enquired in the village and as per enquiry made in the village, it has been reported that the petitioner is no more. He would further submit that as per the enquiry, the petitioner is divorced and he has no children, the father of the petitioner is presently living in a Ashram, at Coimbatore and the only brother of the petitioner is living out of the country.

3. Mr.W.Camyles Gandhi, the learned counsel appearing for the respondent is present before this Court through video conference.

4. In view of the above, this Criminal Revision Petition stands closed as abated.
