PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus to call for the records relating to the impugned order passed by the fourth respondent herein in his proceedings C.No.J1/PR.No.61/2003 dated 23.12.2003 and confirmed Page No.1 of 6
by the third respondent herein in his proceedings C.No.B2/AP.11/2004 dated 16.04.2004 and further confirmed by the second respondent herein in his proceedings Rc.No.97656/PR/I(2)/2004 dated 30.09.2004 and further confirmed by the order of the first respondent herein in his proceedings Rc.No.265485/AP.I(2)/2010 dated 27.07.2011 and quash the same and direct the respondents to reinstate the petitioner in to service together all consequential service and monetary benefits.

ORDER
The learned counsel for the petitioner, who filed the writ petition on behalf of the petitioner, filed a memo as early as on 28.11.2023, informing this Court that the petitioner has taken the bundle along with change of vakalat. A co-ordinate bench of this Court, having taken note of the said memo, directed the Registry to issue notice to the petitioner intimating about the date of hearing and also to verify whether any appearance is entered on behalf of the petitioner. As on date no fresh appearance is entered. Further, notice is also not served on the petitioner as on date in terms of the order dated 28.11.2023.

This Court, having examined the matter and also considering the Page No.2 of 6
fact that the present writ petition is of the year 2011, is of the considered view that the petitioner is fully aware of taking back the bundle from the previous counsel along with change of vakalat. If that be the case, it is the duty and responsibility of the petitioner either to appear in person or to engage another counsel to represent the petitioner. However, the petitioner has chosen not to adopt any of the such options available to her for more than a year, that is, since 28.11.2023.

In view of the same, this Court directed the Registry to print the name of the petitioner in the cause list duly listing the same under the caption 'for dismissal'. Today, inspite of the matter being listed under the caption 'for dismissal', there is no representation for the petitioner. In the circumstances, this Court is left with no other option except to dismiss the writ petition for non-prosecution.

Be that as it may, Mr.P.Ganesan, learned Additional Government Pleader also brought to the notice of this Court that the petitioner had already addressed a Letter dated 08.12.2022 to the 4th respondent, informing the 4th Page No.3 of 6
respondent that the petitioner intends to withdraw the writ petition. 5.
In the light of the above, this Court is not inclined to adjourn the matter any further and accordingly, the writ petition is dismissed for nonprosecution. The connected miscellaneous petitions, if any, shall stand closed. No costs.
