Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for issuance of writ of certiorarified mandamus, to call for the records pertaining to the order dated 02.03.

2010 passed by the 2nd respondent in STC/Enquiry/2834/2009, imposing the petitioner the punishment of reducing his rank from the post of Assistant to the lower grade / post of Junior Assistant and placing him at the junior most position and fixing the petitioner pay at which he was last drawing in the post of Junior Assistant scale before his promotion to the post of Assistant and making him eligible for promotion to the post of Assistant Cadre only on completion of minimum number of years of service in the Junior Assistant Cadre and also the order dated 02.12.2010 passed by the 1st respondent in file No.STC/PD/Disc./181 modifying the punishment imposed by the 2nd respondent into one of reduction in his pay by three stages in the pre-revised time scale of Rs.

6000-120-8640 for the period of three years and making him ineligible for increments during the period of reduction in pay, without cumulative effect, quash the same and consequently direct the respondents to restore his pay with all increments and other consequential benefits together with arrears, award costs.

The learned counsel for the petitioner seeks permission of this Court to withdraw this Writ Petition and he has also made an endorsement to that effect.
