Petitioners PRAYER: Petition for Succession Certificate in respect of certain securities belonging to Mr. K. Gemini under PART X Section 372 of the Indian Succession Act, 1925 and ORDER XXV Rule 6 of the O.S. Rules praying that a Succession Certificate may be granted to the petitioners with the power to collect the debts and to receive interest, specified in the Schedule hereunder.

O R D E R

The above petition is filed by the legal heirs of deceased K. Gemini S/o. Govindasamy in whose name stood the schedule mentioned saving account with the General Post Office, Parrys.

2. The said K. Gemini died intestate on 17.02.2018 leaving behind him surviving his mother G. Chellammal and children the petitioners herein. The wife of the deceased has pre deceased him. Thereafter on 07.11.2018, G.Chellammal, the mother of deceased K. Gemini and grandmother of the petitioners also passed away.

3. The petitioners have therefore filed the above petition for grant of a Succession Certificate in their names. The Paper Publication by them in one issue of Makkal Kular dated 29.01.2020 has not evoked objections from any one.

The 1st petitioner has adduced evidence as PW1 and the death certificate of K.Gemini has been marked as Ex P1, his legal heirship certificate as Ex.P2, a photo copy of the post office saving book bearing A/c.No. 0741072762 standing in the name of the deceased is marked as Ex.P3, Ex.P4 is the death certificate of G. Chellammal and the Paper Publication has been marked as Ex.P5.

5. On a perusal of the Petition and the evidence both oral and documentary it is seen that the petitioners are the only legal heirs of late K. Gemini entitled to the schedule mentioned assets. The Paper Publication has also evoked no objections from any quarter for the grant of the certificate to the petitioner.
