(Order of the Court was made by T.S.SIVAGNANAM, J.) Heard Mr.M.R.Raghavan, learned counsel for the petitioner and Ms.Ramapriya Gopalakrishnan, learned counsel for the respondents.

2. These applications have been filed to condone the delay in re-presenting the papers. These applications are supported by the affidavits filed by the learned counsel for the petitioner. Taking note of the facts and circumstances of the case and only after statutory notice was issued by the learned Single Bench for wilful disobedience of the order and direction in W.P.No.25109 of 2010 etc., batch of writ petitions dated 13.10.2017, the appellant bank appears to have taken effective steps to re-present the papers, the respondents / writ petitioners, though having succeeded before the writ court, inasmuch as the writ petitions filed by the management were dismissed as early as on 13.10.2018, till date are unable to reap the fruits of such order. Therefore, in our considered view, the appellant bank should be directed to pay costs to each of the respondent / employee.

Accordingly, the delay in re-presentation is condoned, subject to the appellant bank / Salem District Central Cooperative Bank Limited pays each of the respondents, a sum of Rs.5,000/- (Rupees Five Thousand only) as costs and such payment shall be made within two weeks from the date of receipt of a copy of this order. In the event the appellant bank fails to comply with the above directions within the time prescribed, the benefit of this order would not enure to the appellant bank and the petitions shall stand automatically dismissed without reference to this Court.
