ORDER
This writ petition is filed for a mandamus in the nature of relief by directing the third respondent to consider the petitioner's representation dated 24.09.2024.
2. On perusal of the said representation as well as the affidavit filed in support of the petition, it is stated that the petitioner's father-in-law died at home. From the records, it transpires that the death itself has not been reported.
3. The learned Government Advocate appearing for the respondents also confirmed the said facts.
4. If that be so, the authorities cannot issue a death certificate. It will be open for the petitioner to approach the appropriate Magistrate under Section 13(3) of the Registration of Births and Deaths Act, 1969 and if the Magistrate finds the case to be true and passes an order, only then the authorities can register the death and issue the certificate. 2/4
5. Keeping open such liberty to the petitioner, this writ petition stands dismissed. No costs.
