Prayer: This Civil Revision Petition is filed under Article 227 of the Constitution of India to set-aside the Impugned Docket Order dated 28.01.2026 made in Unnumbered R.E.A.SR.No.105 of 2026 in R.E.P.No.21 of 2020 in O.S.No.280 of 2010 by the Learned District Munsif Court, Kumarapalayam, Namakkal District and allow the Civil Revision Petition and thus render justice. For Petitioner(s):

M.Vijaya Ragavan Order Heard the learned counsel for the revision petitioner. The order of return of the petition filed by the petitioner for sending of the records has been challenged in the revision petition.

2. I find that initially the application was returned on 22.01.2026 and it has been represented on 28.01.2026, thereafter on the same day, it has again returned with following endorsement:

'' Petition not maintainable at this stage of EP. Obtain the documents through OA, since petitioner is a party to the Suit. Hence return.''

3. Learned counsel for the petitioner states that the records have been consigned to the Central records room, Namakkal and hence, it would not be possible for the petitioner to obtain certified copies. In any event, the petitioner has not represented or complied with return dated 28.01.2026.

4. In view of the difficulties expressed by the learned counsel for the petitioner to apply for certified copies, I am inclined to dispose of the revision petition, directing the petitioner to represent the application with necessary endorsement setting out the inconvenience and difficulty for obtaining the certified copies. Learned District Munsif Court, Kumarapalayam, Namakkal District, shall hear the counsel for the petitioner and thereafter pass orders on the maintainability of the application within a period of two weeks from the date of receipt of a copy of this order.

5. This Civil Revision Petition is disposed of on above terms. No costs. Consequently connected miscellaneous petition is closed. 12-02-2026 Index: Yes/No Speaking/Non-speaking order sk To The District Munsif Court, Kumarapalayam, Namakkal District.
