The petitioner, who was arrested and remanded to judicial custody on 20.08.2022 for the offences punishable under Sections 8(c), 22(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 in Crime No.532 of 2022, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that on receiving a secret information, the respondent Police along with his team went to the scene of occurrence and they found the petitioner along with other accused was found in illegal possession of LSD Stamp-16, which contains 0.270 grams. Hence the case.

3. Learned counsel for the petitioner submitted that this is the second petition for bail and the earlier petition for bail was dismissed by this Court on the ground that the gravity of the offence committed by the petitioner. He further submitted that when the petitioner went to the

Police station to comply the condition, he has been falsely implicated in this case. He also submitted that he is ready to abide by any stringent condition that may be imposed by this Court and he is in judicial custody from 20.08.2022. Hence, he prays to grant bail to the petitioner.

Learned Government Advocate (Crl.Side) submitted that the petitioner along with the other accused were involved in illegal selling of 0.270 grams of LSD Stamp-16 which comes under commercial quantity. He further submitted that there are 11 previous cases pending against him, out of which, some of the cases are similar in nature. Therefore, he vehemently opposed for grant of bail to the petitioner. 6.Taking into consideration the facts and circumstances of the case and also taking note of the quantity of the contraband which is a commercial quantity and that there is no change in circumstances of the case, this Court is not inclined to grant bail to the petitioner.

7.Accordingly, this Criminal Original Petition stands dismissed. 15.02.2023 vkr
