Petition praying that in the circumstances stated therein the High Court will be pleased to Modify the condition imposed by this Hon'ble High Court in Crl.OP.NO.28927 of 2018 dated 11.12.2018 by direction to deposit Rs.5,00,000/-.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.S.SAIRAMAN, Advocate for the petitioner and of Mr.M.Mohamed Riyaz, ADDL. PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- This petition has been filed seeking to modify the condition imposed by this Court in Crl.O.P.No.28927 of 2018 for the offence punishable under Sections 408, 467, 471, 477A, 120(B) of IPC in Crime No.2 of 2018, while granting anticipatory bail.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. The learned counsel for the petitioner would submit that the petitioner finds difficult to comply with the condition due to his economic and health condition. Hence, he prayed to modify the condition imposed by this Court.

The learned Additional Public Prosecutor appearing for the State would submit that the petitioner along with other accused misappropriated funds to the tune of Rs.53,58,200/-, out of which the petitioner is directed to deposit only a sum of Rs.5,00,000/-. https://hcservices.ecourts.gov.in/hcservices/

4.Taking into consideration the nature of the allegation and the submissions made by the learned Additional Public Prosecutor, this Court is not inclined to modify the condition. However, this Court is inclined to extend the time to the petitioner to comply with the condition on or before 22.02.2019, failing which, the Anticipatory Bail granted by this Court shall stand automatically cancelled without any reference to the Court.

5.Accordingly, this Criminal Miscellaneous Petition stands disposed of.
