C.M.P. No.5582 of 2022 in S.A. Sr. No.5866 of 2020 S.S.SUNDAR, J., This petition is filed to condone the delay of 342 days in paying the Court fee in the above second appeal.
2. Heard Ms. P.N.Sivagamasundari, learned counsel for the petitioners
3. In the affidavit filed in support of the petition, it is stated that by mistake, the stamp papers for Court fee was kept in the office bundle and the same was noticed by the counsel only when the appeal bundles were returned for compliance by the Registry. It is reported that the papers were represented along with the Court fee and hence there was the delay. It is further stated that the delay was neither wilful nor wanton.
4. This Court is convinced with the reasons stated in the affidavit filed in support of the petition. Since the delay is properly explained to the satisfaction of this Court, this petition is ordered.
