... Respondent/Respondent This case came up for settlement before the National Lok Adalat. Both the parties are present. The learned counsel for the Appellant, Mr.N.Shanmugasundaram the learned counsel for the respondent, Mr.M.Murali Vinodh Metropolitan Transport Corporation Limited official Mr.A.S.Suresh Babbu,(A.M.Legal) are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT Both the parties and their respective counsel are present.

2. The Appellant/Claimant, had challenged the award of Rs.46,000/- (Rupees Forty Six Thousand only) on the ground of negligence and quantum.

3. Pursuant to the compromise, the respondent/Metropolitan Transport Corporation Limited, has agreed to deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs only) in full quit.

4.The Metropolitan Transport Corporation Limited/respondent, shall deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs only) less the amount already deposited before the Tribunal, if any, within a period of eight (8) weeks from the date of receipt of copy of this order, failing which the Metropolitan Transport Corporation Limited agreed to pay interest at the rate of 7.5% per annum. On such deposit, the claimant/appellant shall be entitled to withdraw the entire amount.

5. The Tribunal is directed to follow the usual mode of payment on proper identification of the party concerned in accordance with the terms of the award without insisting on any formal permission petition. The Civil Miscellaneous Appeal is disposed of accordingly.
