In a proposed suit seeking for specific relief performance and an injunction, the intending plaintiff seeks leave to sue the 1st respondent before this Court.

2.In spite of notice ordered on the respondents and the notice being served on the 1st and 2nd respondents they neither chose to appear before this Court in person or through their counsel. Court notice on the 3rd respondent is still awaited .

3.An application has been filed seeking leave of this Court to institute a suit as against the 1st respondent/ defendant who is residing outside the jurisdiction of this Court. As stated supra, notice has been served upon the 1st defendant, who till date had not chosen to enter appearance. K.KUMARESH BABU,J.

3.Upon considering the above submissions and examining the draft plaint and the affidavit filed in support of this Application, the cause of action for this suit has arisen at least partly within the jurisdiction of this Court. Consequently, A.No.1770 of 2023 is allowed by granting leave to the applicant to sue the first respondent before this Court.
