Apprehending arrest at the hands of the respondent-police, in respect of the alleged commission of offences punishable under Sections 294(b), 341 & 506(ii) IPC, in Crime No.1698 of 2015, the petitioners have approached this Court seeking the relief of anticipatory bail under Section 438 of the Code of Criminal Procedure.
2.There is already civil dispute pending between the family members of the petitioners and the defacto-complainant and criminal complaints have also been filed against each other. While so, the son of the petitioners 1 & 2 scored 484 marks out of 500 in tenth standard and in order to celebrate his success, the 2nd petitioner drew a colourful kolam in front of their house on 21.05.2015 and the said kolam was erased by the defacto-complainant. Hence, there is a quarrel between the petitioners and the defactocomplainant. Pursuant to the same, the present complaint has been lodged against the petitioners.
3.The learned counsel for the petitioners submitted that there is already civil dispute is pending between the parties and this is a false case foisted against the petitioners. Thus, he prayed for grant of anticipatory bail.
4. I have heard the learned Government Advocate (Crl.Side) also.
5. Keeping the submission made on either side, I have carefully gone through the entire materials available on record. Considering the facts and circumstance of the case, I am of the opinion that anticipatory bail could be granted to the petitioners by imposing stringent conditions. Accordingly, the petitioners are directed to be released on bail, in the event of their arrest or on their appearance before the concerned Court, on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties each for a like sum to the satisfaction of the learned XVIII Metropolitan Magistrate, Saidapet, Chennai, and on further condition that the petitioners shall report before the respondent-police as and when required. 6.The petitioners shall appear before the concerned Court within a period of 15 days from the date of receipt of a copy of this order, failing which anticipatory bail shall stand automatically cancelled. 16.07.2015 ssv
