ORDER
This writ petition has been filed for direction directing the first respondent Bank to process the pension papers and death-cum Retirement benefits of Mr.Velusamy, Assistant in the State Bank of India holding I.D.: B, Empl.No.02029, PF Index: 1500066 considering the petitioner's representation dated 01.02.2023 and disburse the amount within a time frame set by this Hon'ble Court.
2. Heard the learned counsel on either side and perused the materials available on record.
3. The petitioner's husband was employed as an Assistant in the State Bank of India, Sirkali Branch. While he was in service, he was charged with an offence of misappropriation alleging that he had forged the signature of the account holder viz., Jeyalakshmi. Based on the allegation, disciplinary proceeding was initiated and criminal case was also registered against him in Crime No.733 of 2007 for the offences
punishable under Sections 408, 420, 468 r/w 109 of IPC. After completion of investigation, final report was filed and the same has been taken cognizance in C.C.No.37 of 2009, on the file of the Judicial Magistrate Court at Sirkali. The petitioner's husband was acquitted in the criminal case. While he was alive, no disciplinary proceeding was initiated as against him. However, the petitioner's husband was suspended from service in the year 2007. Thereafter, the petitioner's husband died. Therefore, the petitioner submitted application for pensionary benefits of her deceased husband.
4. Considering the above, the first respondent is directed to consider the representation submitted by the petitioner dated 07.03.2022 and dispose of the same, on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above directions, this writ petition is disposed of. There shall be no order as to costs.
