O R D E R

Challenging the order of granting maintenance of Rs.3000/- to the respondent, by the Learned Judge, Family Court, Erode in M.C.No.08 of 2015 dated 15.02.2017, the present revision case has been filed.

2. The respondent herein, who is the wife of the petitioner filed a petition under section 125 Cr.P.C., seeking maintenance for a sum of Rs.10,000/- per month. The court below after analyzing the evidence, granted a sum of Rs.3000/-per month as a maintenance. Challenging the same, the present revision has been filed.

3. It is an admitted fact that the respondent is the legally wedded wife of the petitioner and it is also admitted that he is not maintaining her. The petitioner is employed in an educational institution and earning a monthly salary of Rs.12,500/- and he has means to pay maintenance, but the https://hcservices.ecourts.gov.in/hcservices/

respondent has no means to maintain herself. Considering all the above, the court below granted maintenance of a sum of Rs.3,000/- per month. In the above circumstances, I find no irregularity or illegality in the order passed by the court below and hence, the revision is liable to be dismissed.

4. In the result, the Criminal Revision Case is dismissed. Consequently, connected miscellaneous petition is closed.
