ORDER : The Court Made the following order :- The petitioner who was arrested at the hands of the respondent police for the alleged offences under Section 5(m) and 6 of the POSCO Act, in Crime No.18 of 2021 seeks bail.
2. On perusal of FIR, the case of the prosecution is that the petitioner herein who is a teacher alleged to have misbehaved with the defacto complainant's daughter aged about 8 years.
3. The learned Additional Public Prosecutor submits that the investigation completed and a final report already has been filed and taken on file by the Sub Court in P.R.C.No.18 of 2021. If the petitioner is released on bail he may tamper the evidence and may abscond. Hence, she opposed for grant of bail to the petitioner.
4. Considering the objections made by the learned Additional Public Prosecutor and the 164(5) statement of the victim girl, this Court is of the view that releasing the petitioner on bail is not conducive for fair trial.
