Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records of the First Respondent in impugned order in Letter No. 5556/A1/ 2013-2 dated 15.07.2013 and quash the same and consequently to direct the Respondents to post the Petitioner in Madras Medical College, Chennai as per the declaration signed by him during the counseling held on 01.03.2012. O R D E R

Mr. M.Arjun, Learned Counsel representing Mr. N.Vijayakumar, Learned Counsel for the Petitioner states that the Petitioner had collected the case bundle from them earlier with consent for change of vakalat to engage another lawyer and he has made an endorsement to that effect in the court record. It has been informed by the Registry that no one else has entered appearance on behalf of the Petitioner in the matter till date. There does not appear to be any useful purpose being served in keeping the Writ Petition pending indefinitely when the Petitioners are not interested in prosecuting the same.

In the aforesaid circumstances, the Writ Petition is dismissed for non-prosecution. It is made clear that the Petitioner is not precluded from applying for revival of the Writ Petition, if necessary, in accordance with law. No costs.
