CR.NO.555 OF 2017 For Petitioner : M/S.S.P.MEENAKSHSUNDARAM Advocate For Respondent : MR.R.SEKAR, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner apprehends arrest at the hands of the respondent police for the alleged offences under Sections 341, 294(b), 324, 506 (ii) of IPC in Crime No.555 of 2017 and seeks anticipatory bail. 2.The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. 3.Learned Government Advocate (Crl.Side) submitted that due to previous enmity, the petitioner is said to have attacked the defacto complainant and thereby caused injury.

He would submit that petitioner has also abused and threatened the defacto complainant with dire consequences. He further submitted that injured has been discharged from the hospital and further submitted that the coaccused has already been released on bail. 4.Considering the facts and circumstances of the case and taking note of the fact that the injured has been discharged from the hospital and there is no need for custodial interrogation at this stage, this Court is inclined to grant the relief of anticipatory bail to the petitioner.

5.Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Magistrate concerned within a period of 10 days from the date of

receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thiruvotriyur, or to the satisfaction of the respondent police or the police officer who intends to arrest and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m for two weeks and thereafter, as and when required for interrogation.
