ORDER

The petitioner, who was arrested and remanded to judicial custody on 24.12.2025 for the offences punishable under Sections 296(b), 126(2), 351(3) and 103(1) of BNS, 2023 in Crime No.500 of 2025, registered on the file of the respondent police, seeks bail.

The allegation of the petitioner is that due to previous enmity arising out of police intervention in a suicide incident, on 18.12.2025 at about 18.30 hours, when the deceased Sudhakar, who was a village elder involved in local affairs, was present near the cremation ground, A1 abused him alleging that he was responsible for informing the police, and thereafter A2 and A3 followed and attacked him with deadly weapons, resulting in his death. Hence, a case has been registered and the petitioner was arrested.

3. The learned counsel appearing for the petitioner submitted that the petitioner's name does not find place in the FIR and that he is in judicial custody since 24.12.2025. He further submitted that he is ready to co-operate with the investigation. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent reiterated the prosecution case and submitted that a specific overt act is attributed to the petitioner, that he attacked the deceased with a twowheeler mirror and other accused assaulted him with pipe, resulting in his death. He further submitted that the petitioner has four previous cases pending against him. Hence, he opposed to grant bail to the petitioner.

5. Considering the nature of the allegations, the specific overt act attributed to the petitioner in the commission of offence, and that the petitioner is having four previous cases, this Court is not inclined to grant bail to the petitioner.
