Application No.1070 of 2024 in E.P.No.105 of 2018 N.SATHISH KUMAR, J.

This application has been filed to permit the applicant to effect substituted service by way of paper publication in any tamil daily having circulation in Chennai to the 1st respondent, since the 1st respondent could not be served and evading service and the court notice is also returned as 'no such person'.

2. On an earlier occasion, when the Execution Petition was pending, the 1st respondent appeared through learned counsel and when the said E.P. was dismissed for default and thereafter, when an application filed for restoration, service has been effected.

3. In such view of the mater, this Court is of the view that when the person is not found in the address when the petition / application was originally filed, at the later stage, this Court instead of sending summons of notice, it can permit the applicant to effect paper publication.

Accordingly, the present application is ordered and the applicant is permitted effect paper publication in Tamil Daily viz., Dinamalar on 26.03.2024.Post on 26.03.2024.
