[Order of the Court was made by R.SURESH KUMAR, J.] These petitions have been filed to condone the delay of 497 days in filing the petition to set aside the abatement, to set aside the abatement caused due to the death of the petitioner and to bring on record the petitioner herein as a legal representative of the deceased sole petitioner.
2. Heard the learned counsel appearing for both sides.
3. Since the petitioner died, the civil revision petition has become abated, therefore, in order to set aside the abatement, these petitions have been filed with a delay, hence, condone delay petition under Section 5 of the Limitation Act has been filed, also a petition to set aside the 1/3
abatement and to bring the legal representative on record of the deceased sole petitioner also had been filed respectively.
4. Having considered the said facts and circumstances, we feel that these petitions can be allowed, accordingly, these civil miscellaneous petitions are ordered.
5. Registry is directed to carry out the necessary amendments and post the civil revision petition along with the writ appeal after two weeks.
