ORDER : The Court Made the following order :- The petitioner who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 120B, 294(b), 323, 506(i), 498A, 420, 354 IPC r/w Section 4 of Women Harassment Act, 2002 and Section 3(1) of the Dowry Prohibition Act, 1961 in Cr.No.23 of 2020 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that the the petitioner/ first accused and the defacto complainant are husband and wife and due to their wedlock they were blessed with a female child. Thereafter, there was no compatibility inbetween them. In these circumstances, the first accused is alleged to have married A7 while the first marriage is in subsistence.
3.The learned counsel appearing for the petitioner would submit that the petitioner did not commit any offence as alleged by the prosecution.
4.The learned Government Advocate (Criminal Side) submitted that the petitioner has performed second marriage with A7 while the first marriage is in subsistence, which is a heinous offence. https://hcservices.ecourts.gov.in/hcservices/
5.The petitioner has performed second marriage with A7 while the first marriage is in subsistence and that too when he was blessed with a female child. Hence, considering the heinous offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
