Respondents r:- Writ Petition is filed, under the Article 226 of Constitution of India, to issue a Writ of Mandamus, to call for the records from the second respondent CGIT relating to its award dated 03.12.2003 in I.D.No.71/2002, quash the same and consequently direct the first respondent bank to reinstate the petitioner in service with effect from 05.02.1999, together with back wages, continuity of service and other attendant benefits.

The learned counsel appearing for the petitioner reported no instructions from the petitioner.

2. The learned counsel appearing for the first respondent submitted that the petitioner was working as a clerk in the first respondent-Bank and for the misappropriation of funds, though the criminal prosecution initiated has ended in acquittal, the departmental enquiry was initiated in the domestic enquiry, the charges were held to be proved and after following the procedure, the petitioner was removed from the service. Aggrieved against the same, he filed the I.D.No.71/02 before the Central Industrial Tribunal and the same was dismissed on 31.12.2003, confirming the order of dismissal.

3. Therefore, this Writ Petition is dismissed for default. No costs. 10.07.2023 nvi 2/4
