O R D E R

This Criminal Original petition has been filed to set aside order of the learned Principle Session Judge in Crl.MP.No.246 of 2022 dated 25.01.2022 and grant extension of time for a period of one week to comply with the order of the learned Principle Session Judge in Crl.MP.No.1905 of 2020 dated 26.05.2020.

2. The petitioner herein was granted bail for the alleged offence under Sections 430, 379 IPC r/w 21(1)MM (D & R) Act. https://hcservices.ecourts.gov.in/hcservices/

3. While granting bail to the petitioner herein, the trial Court has imposed a condition that the petitioner should deposit Rs.30,000/- to the credit of Chairman/District Collector, District Mineral Foundation Trust of Kancheepuram District. This order came to be passed on 26.05.2020. The petitioner herein has not deposited the said money. He sought for extension of time before the learned Judge who granted bail on condition.

3. The learned Judge on considering the facts declined to extend the time since there was huge lapse of time in complying the order.

4. The learned counsel for the petitioner would submit that the petitioner is an agricultural cooli and due to pandemic situation he was not able to mobilize the money. However, he has now mobilize sufficient money and he will deposit the time within a period of one week and seeks for extension.

5. Taking note of the submission, time is extended till 25/03/2022 for complying the condition. No further extension is granted, failing which, the order will stand automatically cancelled. The other conditions imposed by the Court shall remain intact.
