2. The learned counsel appearing for the second respondent has no objection for allowing this petition.

3. Being satisfied with the reasons stated in the affidavit filed in support of this petition and also considering the submissions of the learned counsel for the second respondent, this Civil Miscellaneous Petition is allowed and C.M.A.No.1199 of 2018 is restored to file.

4. The Registry is directed to post the appeal on 06.06.2023 for arguments.
