Heard Mr.Aravind Subramanian, learned Senior Counsel for the revision petitioners.
2. The revision petitioners are challenging the judgment and decree in O.S.No.8176 of 2008 on the file of V Additional City Civil Court, Chennai on the ground that the plaintiffs in the said suit are interlopers and totally unconnected with the suit property which absolutely belongs to the revision petitioners. However, there has been delay in representing the appeal papers and the said application is pending in
I.A.No.1 of 2025.
3. Learned Senior Counsel would bring to my notice that the two of the respondents have been reported dead and though counsel had entered appearance for all the respondents in the appeal, in the suit, no particulars of legal representatives has been furnished to enable the petitioners to take out necessary application to implead the legal representatives. According to the learned Senior Counsel, the delay is causing seriously prejudice and the petitioners are claiming to be the lawful owners of the property.
4. Considering the fact that the legal heir petition has also been filed and the application pending in I.A.No.1 of 2025 is only for condonation of delay in representing the appeal papers and , the learned I Additional City Civil Court, Chennai shall expedite the enquiry after dealing with the legal heir application and dispose of I.A.No.1 of 2025 on merits and in accordance with law by 31.03.2026.
