Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of a Writ of Certiorari, quashing the order of the 2nd respondent dated 02.02.2005 in reference No.1/25/RCPT/2003 addressed to the Chief Secretary, Government of Tamil Nadu, Chennai in connection with cases Uthangarai P.S Crime Nos.1004, 1005, 1006/2002 and Kallavi P.S. Crime No.434/2002 finding that there is no prima facie case to proceed against the third respondent.

Heard Mr.I.Sathish, learned Additional Government Pleader for the petitioner, Mr.J.Madanagopal Rao, learned Senior Panel Counsel for the respondents 1 and 2 and Mr.R.Sankara subbu, learned counsel for the third respondent.

2. This writ petition has been filed challenging the order of the second respondent dated 02.02.2005 in reference No.1/25/RCPT/2003, where under, the proceedings initiated against the third respondent under Prevention of Terrorism Act was quashed.

3. It is now represented by the learned counsel for the third respondent that the third respondent passed away, hence, the prayer sought for in this writ petition has become infructuous.

4. In the light of the above submission, this writ petition is dismissed as having become infructuous. No costs. Consequently, connected miscellaneous petition is closed.
