Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Mandamus to direct the respondents to consider the petitioner's representation, dated 17.04.2017 and for issuance of free house site patta to the petitioner in Nathan 146/31 and UDR A-Register Survey No.146/1, Patta No.1407, Venganur Village, Tittakudi Circle, Cuddalore District, forthwith to the petitioner forthwith.

ORDER

The petitioner has filed the above Writ Petition praying for issuance of a Writ of Mandamus to direct the respondents to consider the petitioner's representation, dated 17.04.2017 and for issuance of free house site patta to the petitioner in Nathan 146/31 and UDR A-Register Survey No.146/1, Patta No.1407, Venganur Village, Tittakudi Circle, Cuddalore District, to the petitioner forthwith.

2. According to the petitioner, no patta was issued to her, though her possession was recognised, and assignment only was given, but the original patta was not given. Hence, she made a representation, dated 17.04.2017 which 2 / 5

was not considered.

3. Learned Additional Government Pleader appearing for the respondents 1 to 5 submitted that already, the Patta was issued and some third party had encroached on the property in question. Therefore, the petitioner has to work out her remedy in the manner known to law.

4. Since it was only issuance of a Writ of Mandamus, the fourth respondent is directed to issue notice to the petitioner and the rival claimants/interested parties/objectors/aggrieved parties, as the case may be, and after giving notice to all the parties and after giving notice to the parties, conduct enquiry and pass orders in the manner known to law, in case the respondents find that the petitioner is otherwise eligible and entitled to be issued with the patta in respect of the property in question. The above exercise shall be completed within a period of six weeks from the date of receipt of a copy of this order.

5. With the above observations, the Writ Petition is disposed of. There shall be no order as to costs.
