This Criminal Original Petition has been filed to direct the learned Principal District & Sessions Judge, Thiruvallur, to accept the surrender of the petitioner and consider the bail petition on the same day in Crime No.75 of 2017 on the file of the second respondent herein.
2.It is the case of the petitioner that the de facto complainant filed false complaint as against the petitioner [A-2] and his cousin [A-1] under Sections 294[b], 324 and 506[ii] of I.P.C. and Section 3[1][x] of SC & ST [Prevention of Atrocities Act, 1989] in Crime No.75 of 2017 on 07.02.2017. 1 and remanded to judicial custody on the same day and subsequently, he was released on bail by the learned Principal District Sessions Judge, Thiruvallur. Hence, the petitioner filed the present petition to accept his surrender before the learned Principal District Sessions Judge, Thiruvallur and consider the bail petition on the same day.
3.Considering the nature of the prayer sought for and taking note of the fact that the petitioner is prepared to surrender before the learned Principal District & Sessions Judge, Thiruvallur, there shall be a direction to the learned Principal District & Sessions Judge, Thiruvallur, to accept the surrender of the petitioner and consider the bail petition on the same day in Crime No.75 of 2017 on the file of the second respondent, on the same day, on merits and pass appropriate orders.
4.With the above direction, the Criminal Original Petition is disposed of.
