ORDER
This Criminal Petition has been filed praying to direct the 2nd respondent to register the case based on the petitioner's complaint dated 03.04.2014.
2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.
3. On reading of the complaint dated 03.04.2014, it appears that this petitioner has been cheated by the opposite party. The opposite party received a sum of Rs.2,52,000/- from the petitioner promising to arrange financial assistance for him. Thereafter, the opposite party did not make any arrangements. When the opposite party approached this court in Crl.OP.No.21604 https://hcservices.ecourts.gov.in/hcservices/
of 2014 for anticipatory bail, this Court by order dated 16.12.2014, granted interim anticipatory bail on a condition that the opposite party shall deposit a sum of Rs.50,000/- before the Tamil Nadu Legal Services Authority.
4. It is represented that the opposite party has not complied with the order and has been seeking extension of time. Be that as it may, it is clear that the complaint given by the petitioner discloses the commission of cognizable offence and therefore the respondent-Police is directed to register a case and take action in accordance with law as laid down by the Hon'ble Supreme Court in Lalita Kumari Vs Government of Uttar Pradesh and Others in (2014) 2 SCC 1.
With the above direction, this Criminal Original Petition is closed.
