This Civil Revision Petition is filed to set aside the impugned order dated 09.11.2023 in F.No.OSSR No.866/2023 on the file of the District Munsif Court, Chengalpattu.

2. Heard Mr.M.Padmanaban, learned counsel for the petitioner and Mr.C.Sathish, learned Government Advocate appearing for the Respondents.

3. A perusal of the impugned order shows that the plaint was rejected by the District Munsif, Chengalpattu as not maintainable. However, as against the same, an appeal will lie in view of definition of Section 2 (2) of C.P.C., and Section 96 of C.P.C.

4. Therefore, this Civil Revision Petition is closed with liberty to the

petitioner to file an appeal under Section 96 of C.P.C against the order, rejecting of plaint, before the appropriate forum.
