The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 281 of BNS Act read with Section 4(1)(B) of TNP Act in Crime No.20 of 2026, on the file of the respondent Police, seeks anticipatory bail.
2. The allegation against that the petitioner is that the petitioner was found in illegal possession of brandy bottles - 308 Nos ( each containing 180 ml). Hence, the case.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) reiterated the prosecution case and submitted that the petitioner has no previous case, however he opposed for grant of anticipatory bail to the petitioner. 2/4
5. Considering the number of liquor bottles involved in this case and if the petitioner is granted anticipatory bail, he will indulge in similar offence, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
