The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 74, 75(2), 76, 118(1) and 332(c) of BNS and Section 4 of TNPHW Act in Crime No.509 of 2025 on the file of the respondent Police, seeks anticipatory bail. 2.

The allegation against the petitioner herein is that, he trespassed into the defacto complainant's house, sexually assaulted and attempted to rape the defacto complainant's wife, who is suffering from mental illness and physical disability. Hence, this case. 3.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; and that the petitioner is ready to abide by any conditions that may be imposed by this Court, hence sought for anticipatory bail to the petitioner. 4.

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the anticipatory bail to the petitioner 2/4

reiterated the prosecution case and submitted that the victim in this case is suffering from mental illness and bed-ridden; that the petitioner had sexually assaulted her and attempted to commit rape on her; and that the investigation of this case is pending.

Considering the submissions made on both sides, the nature of offence committed by the petitioner herein and taking note of the fact that investigation of this case is pending, this Court is not inclined to grant anticipatory bail to the petitioner.
