O R D E R

This writ petition has been filed for issuance of a Writ of Mandamus to

direct the respondent to consider and pass order on the representation made by the petitioner dated 06.12.2024 within a reasonable time and to settle the monetary benefits.

2. The petitioner had joined the service of the Registration Department as Section Writer on 08.10.1973, he was finally promoted as Grade I Sub Registrar in the year 2008. He was then placed under suspension and not permitted to retire from service due to the pendency of a criminal case. The said criminal case had been registered under Sections 7 & 8 of the Prevention of Corruption Act, 1989 in effect for demand and acceptance of bribe. It is contended that subsequently after trial the petitioner had been acquitted of all the charges. The petitioner now seeks monetary benefits to be paid to him.

3. However, it is the contended on behalf of the respondents that departmental enquiry had been kept in abeyance awaiting the disposal of the criminal case and that the respondents would now once again continue with the departmental proceedings and take up the issue raised thereafter.

4. Accordingly, a direction is issued to the respondent to revive the departmental proceedings and proceed further and come to a logical conclusion

as expeditiously as possible. The representation of the petitioner seeking payment of monetary benefits can be considered only depending on the outcome of the enquiry and not otherwise.

5. With the above observation and direction, the writ petition is disposed of. No costs.
