ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 303(2) of BNS,2023 r/w. 21(1) of Mines and Minerals (Development and Regulation) Act, 1957 in Crime No.23 of 2026, seek anticipatory bail.

2. The allegation against the petitioner is that the petitioner was involved in illegally quarrying 2 units of Norampu sand from the Lake. Hence the complaint.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Therefore, he prays for grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.side) would submit that investigation in this case is pending and the petitioner was involved in illegally quarrying sand from the lake. Hence, she vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the petitioner was involved in illegally quarrying sand from the lake and also damage the water body. Hence, I am not inclined to grant anticipatory bail to the petitioner and if the petitioner is granted bail, he will involve in similar activities. Accordingly, this Criminal Original Petition is dismissed.
