Prayer: Writ Petition is filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st respondent to consider the preliminary issue of maintainability of the application dated 02.04.2019 in Na.Ka.A/1166/2019 filed by the 2nd respondent taking into consideration the objections and contentions raised by the petitioner in its Application in Ref: HR/001/2021 dated 07.01.2021 before proceeding to adjudicate the application on merits and pass such further or other orders.

The relief claimed in this writ petition is as follows: "Directing the 1st respondent to consider the preliminary issue of maintainability of the application dated 02.04.2019 in Na.Ka.A/1166/2019 filed by the 2nd respondent taking into consideration the objections and contentions raised by the petitioner in its Application in Ref: HR/001/2021 dated 07.01.2021 before proceeding to adjudicate the application on merits and pass such further or other orders".

2. However, both the learned counsels consented that it would suffice if the 1st respondent is called upon at the outset to verify as to whether the 2nd respondent union enjoys membership of a considerable 3/6

strength of the employees of the petitioner company. This exercise shall be completed within a period of 3 weeks from the date of receipt of a copy of this order. If the 2nd respondent is able to establish that it has a fairly large strength of the employees, further proceedings shall go on.

3. The Writ Petition is disposed of with the above observations. Consequently, the connected miscellaneous petitions are closed. No costs.
