Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus, directing the respondents to consider my representation dated 06.11.2022 for regularize the service of the petitioner in the light of the orders passed by the 1st respondent in G.O.Ms.No. 68 School Education (R1) Department dated 18.04.2013 and G.O.Ms.No. 247 School Education (r1) Department dated 03.10.12 with effect from the date of their initial appointment with all monetary and service benefits. O R D E R
This writ petition has been filed for the issue of a writ of mandamus directing the respondents to consider the representation made by the petitioner seeking for regularization of her service. 2.Initially, this Court passed an order in the writ petition going by the averments made in the affidavit filed in support of the writ petition. At the verge of the completion of the order, the learned Government Advocate, appearing on behalf of the respondents brought to the notice of this Court that Page No.2 of 6
the petitioner had already approached this Court and filed WP.No.4191/2020, seeking for the very same relief. This writ petition was disposed by this Court on 24.02.2020, by issuing appropriate directions. 3.The above order passed by this Court was followed up and the 1st respondent through proceedings dt.29.07.2021, rejected the claim made by the petitioner.
4.It is quite unfortunate that the petitioner has completely concealed this fact and filed the present writ petition. If the learned Government Advocate had not brought to the notice of this Court regarding the earlier order passed and the consequent proceedings of the 1st respondent, this Court would not have been aware of the attitude of the petitioner. 5.The petitioner has come to this Court with unclean hands and she has concealed the filing of the earlier writ petition. In view of the same, this writ petition stands dismissed with cost of Rs.5,000/- [Rupees Five Thousand only] payable by the petitioner to the Tamil Nadu State Legal Services Authority, within a period of two weeks from the date of receipt of copy of Page No.3 of 6
this order.
6.Post this case under the caption for reporting compliance on 27.02.2022.
