ORDER

This writ petition has been filed to call for the records and quash the same relating to the impugned order passed by the 2nd respondent vide Na.Ka. 3543/97-98/01 and consequently direct the respondents to grant Subsistence Allowance from the date of the suspension.

2. It is stated that the petitioner was working as Manager in the Thudiyalur Co-operative Agricultural Services (TUCAS) Bank. While so, it is alleged that relating to irregularities in jewel loan transactions during her tenure, the petitioner was placed under suspension by the 2nd respondent vide proceedings Na.Ka.25/2025-26/01 dated 19.04.2025. It is the grievance of the petitioner that though the suspension was ordered on 19.04.2025, the same has not been revoked till date and the disciplinary proceedings have also not been concluded. Hence, challenging the prolonged suspension, the present writ petition has been filed.

3. Learned counsel for the petitioner submitted that without conducting preliminary enquiry and without affording any opportunity to the petitioner, the impugned suspension order dated 19.04.2025 was issued to the petitioner. He 2/5

strongly argued that though suspension order was issued, charges were not framed and the respondents failed to initiate disciplinary proceedings despite lapse of several months, which will clearly demonstrates arbitrariness.

4. Learned counsel further submitted that even though a request for subsistence allowance was made by the petitioner, the same was rejected by the 2nd respondent vide order dated 26.05.2025. Thereafter, the petitioner submitted a detailed representation dated 01.11.2025 seeking revocation of suspension and grant of subsistence allowance, but no orders have been passed on the same till date.

Per contra, the learned Government Advocate appearing for the respondents submitted that the petitioner, while working as Manager, allegedly committed certain irregularities and misappropriation in sanctioning jewel loans, which resulted in serious financial irregularities. Hence, the petitioner was placed under suspension and disciplinary proceedings were initiated. He further submitted that a charge memo was issued to the petitioner on 13.11.2025 and the petitioner has submitted her explanation on 24.11.2025. He also submitted that the disciplinary proceedings will be concluded within a reasonable time that may be fixed by this Court.

6. Considering the aforesaid submissions made by learned counsel on either side and without going into the merits of the allegations, this Court directs 3/5

the respondents to proceed with the disciplinary proceedings pursuant to the charge memo dated 13.11.2025 and conclude the same as expeditiously as possible, preferably within a period of twelve weeks from the date of receipt of a copy of this order.
