PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India, against the judgment and decree in CMA(CS)No.13 of 2007 dated 02.04.2009 on the file of the Principal District Judge, Villupuram. O R D E R Villupuram Co-operative Urban Bank Limited is the Revision Petitioner herein.

2. Surcharge proceedings have been initiated against the first respondent herein based upon the enquiry report submitted under Section 81 of the Tamil Nadu Co-operative Societies Act and the same was challenged. Thereafter, surcharge order was passed by the second respondent herein, whereby decree amount and interest have been awarded. The same was challenged before the Principal District Court in C.M.A(CS).No.13 of 2007 and the same was allowed. Hence, this Civil Revision Petition. Since the appeal before the District Court ended in favour of delinquent, the Co-operative Urban Bank has preferred the revision petition.

3. The learned Government Advocate appearing for the second respondent has produced a letter dated 12.02.2020 from the revision petitioner herein stating that the subject matter of the dispute being the amount, are duly paid by the borrower and the loan was discharged. Hence, nothing survives in this petition. The letter given by the petitioner herein is perused.
