2.Mr.Swami Subramanian, learned counsel on record for petitioner and Ms.Danalatchumy, learned counsel representing Mr.K.S.Mohandass, learned Public Prosecutor (Puducherry) who accepts notice for respondent are before us.

3. Learned counsel for petitioner adverting to support affidavit, more particularly paragraph No.5 therein submits that the deponent of affidavit who is pursuing appeal is a college student (studying first year) faced considerable difficulty in finding a lawyer and preferring the appeal. 4. Considering the facts and circumstances of the case and nature of the matter, we have no difficulty in accepting the reason qua COD prayer.
