ORDER

Initially, this Writ Petition was filed for the issuance of Writ of Mandamus, directing the respondents 1 and 2 to consider and pass appropriate order of the appointment on the petitioner to the reported vacancy of Noon Meal Organizer post at Thennagaram Panchayat Union Primary School by virtue of order in Na.Ka.No.4646/2010 r/c/jp dated 25.08.2010 passed by first respondent in pursuance to order passed in W.P.No.15406 of 2008 dated 13.07.2010. Subsequently, the petitioner filed an amendment petition and the amended prayer is as follows:- "This Writ Petition has been filed for the issuance of Writ of Certiorarified Mandamus, calling for records relating to impugned order in Na.Ka.No.4646/2010 r/c/jp-1 dated 25.08.2010 on the file of the first respondent and quash the same consequently direct the respondents 1 and 2 to appoint the petitioner as Noon Meal Organizer to Panchayat Union Primary School at Thennagaram.

(Prayer amended as per order dated 10.12.2011 in M.P.No.2 of 2011 in

W.P.No.28039 of 2011)".

2. There is no representation on behalf of the petitioner. Heard Mr.M.Muthusamy, learned Government Advocate appearing for the first respondent and Mr.M.Digvijapandian, learned counsel appearing for the second respondent and perused the materials available on record.

3. The learned counsel for the respondents submitted that the maximum age is 40 years for appointment to the post of Noon Meal Organizer. Now, the petitioner had crossed the age of more than 40 years.

4. Therefore, the request made by the petitioner cannot be considered and this writ petition is devoid of merits and is liable to be dismissed. Accordingly, this writ petition stands dismissed. Consequently, connected Miscellaneous petition is closed. No costs.
