ORDER

This Criminal Original Petition has been filed challenging the charge sheet in CC.No.276 of 2022 pending on the file of the Chief Judicial Magistrate, Puducherry and to quash the same.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor (Pondy) for the first respondent and perused the materials placed on record.

3. On instructions, the learned Additional Public Prosecutor (Pondy) appearing for the first respondent submitted that the trial has been commenced in CC.No.276 of 2022, on the file of the Chief Judicial Magistrate, Puducherry. So far, the prosecution had examined PW1. Already the petitioner filed a petition to discharge from all the charges and the same was dismissed on 07.02.2023 in Crl.M.P.No.9891 of 2022 in C.C.No.276 of 2022 on the file of the Judicial Magistrate, Puducherry. Aggrieved by the same, the petitioner filed a revision before this Court in Crl.R.C.No.453 of 2023 and the same was dismissed by this Court on 12.07.2024.

4. In view of the above, this Court finds no grounds to quash the

proceedings, since the entire trial has been already commenced and the prosecution had examined PW1 so far. The Trial Court is directed to complete the Trial in CC.No.276 of 2022, within a period of six months from the date of receipt of a copy of this order.

5. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected Miscellaneous petition is closed. 07.02.2025 Internet:Yes Index:Yes/No Speaking/Non speaking order mn
