Writ Petition filed under Article 226 of the Constitution of India, praying to issue a writ of mandamus directing the respondents to consider the petitioner's representation dated 30.01.2018 requesting for transfer and regular posting at his native Panchayat, namely, Valikandapuram Panchayat. ORDER

The petitioner is working as Panchayat Secretary now at Anukkur Village Panchayat and additional charge of Valikandapuram Village Panchayat, which is his native place, was given to him consequent from the vacancy at Valikandapuram. It is submitted that so far as the appointment of Panchayat Secretary is concerned priority is required to be given to persons who are also residents of the same Panchayat. In such premises, the petitioner has made a representation to the first respondent to consider his case for transfer to Valikandapuram Village Panchayat as he is also a resident of that village. Such representation dated 30.01.2018 is pending for consideration of respondent No.1. Hence he has come to file the present writ petition seeking a direction to dispose of his such representation.

2. Mr.V.Kathirvelu, learned Special Government Pleader appearing for the State has no serious objection in considering the petitioner's representation in accordance with law.

In such premises, no useful purpose is going to be served by keeping the writ petition pending seeking the reply affidavit and as such this Court disposes of this writ petition without reply affidavit with a direction to the respondent No.1 to consider the representation of the writ petitioner in accordance with law within a period of six weeks from the date of receipt of a copy of this Order.

4. However, it is made clear that this Court has not expressed any opinion on merits on such representation made by the writ petitioner.

5. With the above observations, the writ petition stands disposed of. However in the circumstances there shall be no order as to costs.
