In a proposed suit for declaration of title to an immovable property and for injunctive relief in relation thereto, the intending plaintiff has presented this application for leave to sue the defendant before this Court.

Learned counsel submits that the immovable asset is situated within the jurisdiction of this Court and the present application is filed because the defendant resides outside the jurisdiction of this Court. Upon examining the draft plaint and on considering the above submissions, it is evident that the cause of action has arisen within the jurisdiction of this Court. Consequently, A.No.820 of 2023 is allowed by granting leave to the applicant to sue the respondent before this Court.
