..Respondent(s) Prayer: This writ petition is filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the Respondents herein to consider and pass orders on the petitioner's representation dated 15.01.2021 to register the sale deed sent by The Principal Sub Judge, Vellore, in E.P.No.127 of 2019 in O.S.No.154 of 2008 to enable the petitioner to avail the benefit of Regulations Scheme to regularize the Unauthorized Plot Nos.15,16,17,37 and 38 in S.Nos.109/1A and 109/2 Situated in Karugampathur Village, Vellore Taluk, Vellore District.

ORDER

This writ petition has been filed to direct the respondent to consider the petitioner's representation dated 15.01.2021.

2. In this case, the petitioner has given a representation dated 15.01.2021 to register the Sale Deed sent by the Principal Sub Judge, Vellore in E.P.No.127 of 2019 in O.S.No.154 of 2008 to enable the petitioner to avail the benefit of Regularisation Scheme to regularize the Unauthorized Plot Nos.15, 16, 17, 37 and 38 in S.Nos.109/1A and 109/2 situated in Karugampathur Village, Vellore Taluk, Vellore District. However, the said representation was not considered by the respondents, as on date. Hence, this petition.

3. Learned counsel for the petitioner would submit that the issue in this writ petition has been settled between the parties, amicably. Therefore, he prayed this Court to issue direction to the respondent to refund the stamp duty along with registration charges.

4. In reply, learned Government Advocate appearing for the respondent would submit that in the event, the petitioner makes any representation before the respondent, the same will be considered in accordance with law.

5. Heard the learned counsel on either side and perused the materials available on record.

6. In view of the above, this writ petition is disposed of with a liberty to the petitioner to make an application for refund of stamp duty along with

registration charges, before the respondent. On such receipt, the respondent is directed to consider the same, if he is eligible, within a period of eight (8) weeks from the date of receipt of the said representation. No costs. Consequently, connected miscellaneous petition is closed.
