Respondents Prayer : Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the 2nd respondent to act upon the petitioner's application dated 13.12.2022 and survey and fix the boundaries for the petitioner's land in Survey No.10/3 measuring 1.03 acres of Ayothipattinam Village, Vazhapadi Taluk, Salem District and identify and fix the boundaries of the same and grant patta within a time to be stipulated by this Hon'ble Court. O R D E R
The prayer sought for herein is for a Writ of Mandamus directing the 2nd respondent to act upon the petitioner's application dated 13.12.2022 and survey and fix the boundaries for the petitioner's land in Survey No.10/3 measuring 1.03 acres of Ayothipattinam Village, Vazhapadi Taluk, Salem District and identify and fix the boundaries of the same and grant patta within a time to be stipulated by this Court.
2. In respect of the land situated in Survey No.10/3 measuring 1.03 acres of Ayothipattinam Village, Vazhapadi Taluk, Salem District, the petitioner had given an application dated 13.12.2022 and has paid the necessary fee to that effect for surveying the land and to identify the found boundaries. In order to consider the said representation, the petitioner has approached this Court.
3. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents.
4. Learned Government Advocate would submit that the 2nd respondent Tahsildar would consider the representation of the petitioner and do the needful to complete the survey within a time frame that may be stipulated by this Court. 2 / 4
5. Considering the submission made by the learned Government Advocate, this Court is inclined to dispose of this writ petition with the following order. "That there shall be a direction to the 2nd respondent to act upon the application of the petitioner dated 13.12.2022 and do the needful to complete the survey and identify the boundaries of the petitioner's land within a period of eight weeks from the date of receipt of a copy of this order. "
