Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records relating to the Combined Seniority List of Headmaster - Elementary School BT Assistants, Tamil Pandits for the post Headmaster Middle School prepared by the fourth respondent dated 05.04.2011 and consequential panel of BT Assistants for the promotion to the post of Headmaster - Middle School and quash the same insofar as the respondents 5 to 19 are concerned and direct the respondents to promote the petitioner to the post of Headmaster - Middle School by implementing the Elementary School Headmaster panel prepared for the post of Headmaster - Middle School by the respondent dated 05.04.2011 and confer all the consequential benefits.

ORDER

This writ petition is filed seeking a Writ of Certiorarified Mandamus to call for the records relating to the Combined Seniority List of Headmaster - Elementary School BT Assistants, Tamil Pandits for the post Headmaster Middle School prepared by the fourth respondent dated 05.04.2011 and consequential panel of BT Assistants for the promotion to the post of Headmaster - Middle School and quash the same insofar as the respondents 5 to 19 are concerned and direct the respondents to promote the petitioner to the post of Headmaster - Middle School by implementing the Elementary School Headmaster panel prepared for the post of Headmaster - Middle School by the respondent dated 05.04.2011 and confer all the consequential benefits.

It is represented by the learned Government Advocate that the issue arises for consideration in this writ petition has already came up for consideration before the Madurai Bench of this Court in W.P. (MD) Nos.8755 to 8952 of 2010 wherein the identical relief sought for in the said writ petition was dismissed by the Madurai Bench of this Court by an order dated 18.11.2010.

3. The learned counsel for the petitioner fairly concurred with the above submission of the learned Government Advocate.

4. In the light of the above, this Court is of the considered view that this writ petition is also liable to be dismissed for the reason already assigned in the order dated 18.11.2010 in W.P. (MD) Nos.8755 to 8952 of 2010.
