PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a Writ of Habeas Corpus, directing the respondents to produce the Sankar aged 49 years, S/o.Venugopal who is now detained in Central Prison, at Vellore in pursuance of the detention order passed by the 2nd respondent vide ref. D.O.No.27/2017-C2, dated 20.07.2017 as a "Black Marketer" under the Prevention of Black Marketing and Maintenance of supplies of Essential Commodities Act 1980 (Act No.7 of 1980) before this Court and for the records quash the order and set the detenu at liberty forthwith.

O R D E R

(Order of the Court was made by RAJIV SHAKDHER, J) 1.

The petitioner is the wife of the detenu, namely, Sankar, S/o.Venugopal, male, aged about 49 years. The detenu has been detained by the second respondent by his order in D.O.No.27/2017-C2, dated 20.07.2017, wherein he has been held to be a "Black Marketeer", as contemplated under the Prevention of Black Marketing and Maintenance of Supplies of Essential Commodities Act, 1980 (Central Act No.7 of 1980). 1.1. The said order is under challenge in this Habeas Corpus Petition.

2. The learned Additional Public Prosecutor submits that the said order of detention, passed by the second respondent against the husband of the petitioner has been revoked by the Government in G.O.Rt.No.256, Cooperation, Food and Consumer Protection (E1) Department dated 08.09.2017; a copy of the order has also been produced.
