M.P.No.2 of 2015 in W.P.No.2074 of 2014 M.DURAISWAMY,J., By order dated 03.06.2015, this court, while dismissing the Civil Revision Petition, granted time till 08.06.2015 to comply with the conditional order passed by the Rent Control Appellate Authority to deposit a sum of Rs.8,00,000/- to the credit of R.C.A.No.225 of 2015 on the file of VIII Judge, Court of Small Causes, Chennai. Now, the petitioners have filed the above petition to grant extension of time for a further period of 6 months from 08.06.2015.
2. In the affidavit filed in support of the above petition, the petitioners have stated that they are running a small Grocery Shop in the said premises and the business is very dull and therefore, they are not in a position to comply with the order dated 03.06.2015 by depositing a sum of Rs.8,00,000/- on or before 08.06.2015. In these circumstances, the petitioners sought for extension of further time.
3. Since the Civil Revision Petition was dismissed at the admission stage itself, taking into consideration the averments stated in the affidavit field in support of the petition, I grant a further time of four weeks for complying with the order dated 03.06.2015. The petitioners shall deposit the
sum of Rs.8,00,000/- to the credit of R.C.A.No.225 of 2015 on the file of VIII Judge, Court of Small Causes, Chennai on or before 09.07.2015. On such deposit being made by th petitioners, the VIII Judge, Court of Small Causes, Chennai shall deposit the said sum of Rs.8,00,000/- in a Fixed Deposit under reinvestment scheme in Indian Bank, High Court Branch initially for a period of one year.
4.The learned counsel appearing for the petitioners submitted that the Rent Control Appellate Authority may be directed to dispose of the appeal within a stipulated time.
5. Having regard to the submission made by the learned counsel appearing for the petitioners, I direct the VIII Judge, Court of Small Causes, Chennai to dispose of the appeal in R.C.A.No.225 of 2015 on merits and in accordance with law, within a period of three months from the date of receipt of a copy of this order.
