ORDER

This writ petition has been filed to direct the respondents 1 to 3 to indicate the pathway in the property morefully described in the prayer to this writ petition while conducting survey and demarcation of the boundaries based on the request made by the sixth respondent.

2. Mr. D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 4. Mr. R.Venkatesa Perumal, learned Govt Advocate (Crl. Side) accepts notice on behalf of the respondent No.5. Since no adverse orders are passed against the sixth respondent, notice to the sixth respondent is dispensed with by this Court.

The learned Special Government Pleader would submit that pursuant to the directions issued by this Court in the writ petition filed by the sixth respondent, survey and demarcation of boundaries has already been completed and survey report has also been submitted. However, the learned counsel for the petitioner would submit that though there is a pathway in the property, the same has been left out in the survey report.

4. The learned counsel for the petitioner would also submit that the petitioner has already preferred an appeal as against the survey report submitted by the second respondent for the subject property. He would also submit that civil suits are also pending pertaining to the very same property. According to him, the same was suppressed by the sixth respondent in the writ petition filed by him before this Court.

5. This Court is not expressing any opinion on the merits of the respective contentions. Since the petitioner has already preferred an appeal as against the survey report submitted by the Tahsildar, pursuant to the directions issued by this Court in the writ petition filed by the sixth respondent, necessarily the petitioner will have to redress his grievance only before the appellate authority. The only limited relief that can be granted to the petitioner in this writ petition is to direct the appellate authority to dispose of the petitioner's appeal within a time frame to be fixed by this Court.

Accordingly, this Court directs the appellate authority to dispose of the petitioner's appeal dated 14.01.2026 on merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. Since the appellate authority is not a party respondent in this writ petition, this Court by exercising its suo motu power impleads the Revenue Divisional Officer, Mettur as the party seventh respondent in this writ petition. Registry is directed to carryout necessary amendment.

7. Accordingly, this writ petition is disposed of. No Costs. Consequently, connected miscellaneous petition is ordered subject to payment of single Court fee.
